NEWS: CHANGE IN NEW YORK DIVORCE LAW

“Here, I pause to offer a prayer for my gentle reader: May you never, ever, have to get a divorce in New York.”  - Eat, Pray, Love by Elizabeth Gilbert

Thanks to recent action by the New York State Legislature, New York now has a no-fault divorce option, which allows spouses to end their marriage if it is “irretrievably broken" for at least six months.

Elizabeth Gilbert’s above-referenced prayer for her New York readers is now obsolete. Her prayer referred to New York’s divorce law, which previously required proof of “grounds” for divorce. This often engendered protracted court proceedings, exacerbated conflict between the divorcing spouses, and/or caused them to manufacture accusations such as “constructive abandonment.”

This new law, effective October 12, 2010, gives people a relatively simple, dignified alternative for dissolving their marriage.
